Roger Smith is a crime reporter for the Weekly Rag. During an election period in Victoria, Roger reports that violent crimes committed by Sudanese youths have doubled in twelve months. He writes that 'Sudanese criminals should go home', and he describes them as 'beasts' and 'animals'. In an article published in the Weekly Rag, Roger calls for all Sudanese youths to be deported.

The crime figures referred to by Smith are wrong. Sudanese youths are actually committing no more crimes than any other group. The figures were provided to Smith by a source within Victoria Police who had provided reliable information to him previously. Smith did not verify the figures independently before writing the article.

Several members of the Sudanese community come to you for advice. They want to take legal action in respect of the articles, but they do not want to sue for defamation. Advise the individuals regarding their rights in respect of the articles, including any defences that may be raised.
