On 1 August, Cindy saw the advertisement and called Rachel to arrange a home visit. The next day, Cindy went to 99 Chi Shin Street, Tseung Kwan O to meet Rachel. Having visited Rachel at her home, she decided that it was safe and that Rachel would be the perfect babysitter to take care of her son, Josh.

During the visit, Cindy and Rachel had the following conversation:

Cindy: I am currently working as a Special Educational Needs (SEN) teacher at Tai Wai. I need someone to take care of my son Josh beginning 1 September till 1 December. Every Monday to Friday, between the hours of 9:00a.m. and 5:00p.m. As to the price, $2000 per week is a lot of money. I'd like to talk to my husband first.

Rachel: I can babysit Josh during the semester. If you want, you can drop him off on the first day of the semester. I have time on my hands to do that. It will cost $2000 a week for me to babysit Josh.

Cindy: My husband and I are going on a staycation for a few weeks before the start of term. I am so glad that I found you, I was so worried before. Let me talk to my husband first. If my husband is fine with the price, I will and let you know before 1 September and bring him here on 1 September. That evening, Cindy spoke to her husband and decided that they had sufficient money for Rachel to babysit Josh, but Cindy did not contact Rachel to tell her. The next day, Cindy and her husband went on their staycation. They returned on 30 August. In the meantime, Rachel placed another advertisement in the same newspaper on 20 August to retract the earlier advertisement:

Cindy took Josh to Rachel's house on 1 September. When she arrived, she saw a note on the doorbell that said: "Rachel's Babysitting Service - FULLY BOOKED TILL EARLY NEXT YEAR". Cindy thought the reason as to why Rachel said she is fully booked is because of her. Cindy then rang the doorbell and Rachel opened the door. When Rachel saw Cindy and Josh, she said: "Oh, you never called me back, many people responded and I am sorry to tell you I don't have time to babysit Josh anymore. I place an advertisement on 20 August to inform everybody I am fully booked till next year. Since Cindy was on her staycation, she did not see the advertisement. Cindy was stuck with Josh for the first few days of the new semester. Eventually, she managed to find someone to babysit Josh for $2500/per week. Cindy is very upset and decides to sue Rachel for her expenses and the extra $500 that she incurred because of this incident.
