Rachel, who lives in Shoreham-by-Sea, wishes to buy a small boat for her and her family to use during the summer holidays, and asks a local specialist agent to find a suitable boat. The agent provides photographs and details of several boats, and Rachel decides to purchase 'The Little Mermaid' for the price of 10,000. The boat is currently moored at a marina 150 miles away. She does not have time to go and check out the boat personally relies on the following information given by the agent:

Rachel buys the boat and arranges to have it delivered. When it arrives, she discovers that the exterior of the boat is in a poor state of repair and requires sanding, wood treatments, and repainting. According to the service history 'logbook' the boat's engine has not been serviced for over two years. Subsequently she discovers that she could have got a similar boat in good condition for 7000.
