Ralph Kramden went into his boss's office to confront his boss about why Ralph was passed over for a promotion to bus dispatcher at the Gotham Bus Company.During the argument, Mr. Monahan, Ralph's boss, tells Ralph that he is not supervisor material, and escorts him to the door of his office.At the doorway, Ralph turns to face his boss as Monahan is lighting a cigar."Let me tell you something, boss," Ralph screams as he charges back into the room.Monahan sees Ralph coming at him with his hands raised in a fist and Monahan throws up his arms dropping the lighter he used to light his cigar onto Ralph's foot.Ralph jumps back when the fire from the lighter hits his shoe and quickly douse the flame by stomping on his shoe with his other foot.He then charges at Monahan and throws his boss backward over the boss's desk then storms out of the office.

Ralph is later arrested and charged with assault.At his trial, the DA calls Junior Monahan, Mr. Monahan's seven year old son who was visiting his father at work at the time of the incident.When Ralph began screaming at the boy's father, Junior ran and hid in a closet in the office.The DA calls him to testify to the fact that he cracked the door open to see what was going on.Ralph's lawyer requests a hearing pursuant to CPL 60.20 on the issue of the boy's ability to testify under oath.At the hearing, the DA asks the boy if he knows the difference between a lie and the truth.The boy replies, "Yeah, a lie is something that is not true and the truth is something that is true."He correctly identifies the judge and what the role of the judge is as well as the lawyers and the court personnel in the courtroom.He testifies that he is in the second grade and has been on the honor role at school all throughout first and second grade.On cross examination, he testifies that he has told lies in the past to his parents, but they forgave him so there were no consequences to his lies, but he tries not to lie to them anymore "because you shouldn't lie."When asked why you shouldn't lie, he replies, "Because you just shouldn't."The defense attorney objects to the boy testifying, and, in the alternative, if the boy is allowed to testify, objects to the boy testifying under oath.

During the defense of the case, Ralph testifies that he believed that Mr. Monahan burned him on purpose and was trying to protect himself from further harm from his boss.Additionally, Ralph testifies that has had a clean work record at work.On cross examination, the DA asks Ralph about an argument he had had with Freddy Muller, another bus driver, during which, Ralph hit Freddy in the jaw cracking one of his teeth.He also asks Ralph about an incident where he crashed his bus into a parked car causing the company to pay $25,000 in damages to settle a lawsuit.Ralph's attorney objects to both questions.
