1. Ram & Shyam, students of Manipal university were returning to their hostel after visiting Malpe beach. While negotiating a steep gradient, the rider lost control and their motorbike had an accident. Both the rider and pillion were injured. The local people in the vicinity got both the boys admitted to hospital. Since Ram's injuries were minor, he was taken to District Government hospital Udupi. However, Shyam's injuries were grievous and hence he was taken to a multi-specialty 'Hi-tech' Pvt hospital Ltd based out of Udupi. Unfortunately, both suffered from deficiency in service, as they were in pain even after discharge from hospital, due to improper joining of fractured bones. The hospitals did not respond to their pleas and hence the two consumers were looking at legal remedies. Please advise both students. What is the remedy if Shyam is dissatisfied with the lower court's award?
