Case study;

Timothy was employed as a manager of a Sussex care home since December 2015. He replaced the former manager, Mathew, who had left the care home in a state of disorder.

Shortly after starting his employment, while checking through papers at the care home, Timothy discovered that significant sums of residents' money could not be accounted for. Timothy realized that care workers at the home had been stealing from vulnerable residents, and Mathew had allowed this to continue for some years. Timothy mentioned that Mathew was responsible behind ignoring such activities of care workers.

Timothy first raised his discovery with Sophia, his Regional Director. In this process Timothy prepared a complete report about misdeed that were happened in the past and submitted his report to Sophia on 2016 March 12. Sophia, however, was more concerned that the local authority should not become too interested in the care home as its reputation would be at stake. She therefore sought to minimize the amounts stolen as set out in his whistleblowing report to prevent the attention of the local authority's Safeguarding team.

Worried that the company were not taking the issue seriously, Timothy took it upon himself to contact the police, but as soon as Sophia became aware that Timothy had gone over her head, she began making his life difficult.

Sophia's attitude towards him completely changed. She accused him of undermining her. She said his performance was not what it should be, setting him objectives which were unachievable. She also encouraged other staff to ignore and ostracize him in workplace.

Timothy raised a grievance about this treatment to the higher authority. This was not investigated properly; the Managing Director of Sussex care home sided with Sophia over Timothy and did not uphold his grievances.

Timothy resigned andlodged a claim against Sussex care home at Sussex Employment Tribunal on 20 July 2016, claiming constructive dismissal.
