Recently, there was a viral TikTok video where a TikToker went to Home Depot. He found several boxes of plants that were marked on sale for one penny. He went to the register to pay for them when a Home Depot employee stopped him and informed him that he could not buy the boxes for a penny each.

Commenters were divided on whether Home Depot was obligated to sell the boxes for the marked price.

Let's say that the one-cent sticker on the boxes is a validofferfrom Home Depot to sell those boxes for one penny. When the TikToker brings the boxes to the register and takes out his credit card to pay for them, that action would be considered anacceptanceand therefore it would create a contract. In other words, Home Depot wouldlegallybe required to sell the TikToker the boxes for one cent.

BUT if that one-cent sticker on the box is NOT a valid offer (instead, it's what we call an 'invitation for an offer' - you'll learn more about this later in this Module), then there is nothing for the TikToker to accept. And therefore, no valid contract. Home Depot would NOT be legally required to sell the boxes to the TikToker for one cent.
