• Effective advocates will argue that the outcome of a relevant case should or should not be the same for a client by arguing the fairness of applying that same outcome to the client. Fairness can depend on whether the facts are similar, or are they significantly different?
• Is the court's reasoning in the case inapplicable to the client's situation? Can you imagine a situation in which the holding of Ciraolo would seem unfair?
