Read Michael Silverstri v. Optus Software, Inc. on pages 341-342 carefully. Note that the trial court granted summary judgment for Optus (Optus won without a trial). But the Appeals Court reversed that decision and Silverstri won. But then the Supreme Court of New Jersey (the decision you are reading) overturned the Appeals Court, and Optus won.
