1.A landowner and farmer entered into a sharecrop agreement whereby the farmer would farm the land provided it was free of weeds. The landowner, although not a farmer, represented the land to be free of weeds, in the presence of witnesses. The farmer seeded the land, but once things began to grow, discovered the land to be so weedy that he had to abandon his crop. The landowner sued for the first year's rent and damages. The farmer counterclaimed that the landowner had misrepresented the land and claimed for the expenses of seeding the land. The court held that the landowner had innocently misrepresented the land as weed-free, and dismissed the landowner's claim.
