Abigale and Betty are coworkers (waitresses) at The Big Chef Restaurant. Abigale works the lunch shift from 10am to 3pm, and Betty works the dinner shift from 5pm to 10pm. Betty is going on a 10-day vacation and during a short conversation between the two, Betty asks Abigale to pick-up her dinner shifts at the Big Chef while she is on vacation, and to take care of her 3 dogs she has at home. She also asks Abigale pick up her mail at the post office and generally take care of her house while she is gone. Betty tells Abigale, if you do this, I will be your best friend "forever" and pay you for your time and pick up your shifts whenever you need it. Betty tells Abigale don't worry, when I get back I will "take care of you"!
Abigale agrees and trusts that Betty will "take care of her" when she gets back. While Betty is gone, Abigale does exactly what Betty requested - however, its not easy. In short, Abigale's life during the 10-day period is a "living hell" because she has to work 2 shifts each day, drive to Betty's house 3 times a day (which is 25 miles away) to feed/walk the pets and take care of Betty's house. Moreover, on the 3rd day, Betty's water heater breaks, and Abigale has to hire and pay a plumber $300 (out of her own money) to fix it. Needless to say, Abigale is very frustrated and can't wait until Betty gets home.
When Betty gets home Abigale is relieved, and immediately asks Betty to pick up her lunch shift so she can take a day off and rest. She also asks Betty for $500. Specifically, Abigale wants $300 to reimburse her for the water heater, and a $200 to cover gas for her car because she had to travel so much to feed the pets.
Betty, to the dismay of Abigale, states that she cannot pick up the lunch shift because she is quitting the job at the Big Chef, and going back to school full time. She also tells Abigale that she does not have the $500 to give to Abigale since she has been on vacation and not working . . . and plus, she tells Abigale, that she did not "approve" the repairs to the water heater . . . in short, she tells Abigale that "you did that on your own, why should I have to pay for it."
Obviously, Abigale is mad . . not only did she go out of her way to help Betty, and had to live a very stressed life for 10 days to help her, she is out about $500.
Based on the fact pattern above, answer the following:
1. Is the agreement between Abigale and Betty described above (i.e.,for Abigale to pick up Betty's lunch shifts, take care of her pets, etc.), a valid and enforceable contract.
Answer yes or no, then explain why it is or is not a valid and enforceable contract.
2. Assume, that the agreement between Abigale and Betty is not a valid and enforceable contract. In such case, without a valid and enforceable contract, please (A) explain what legal theories Abigale may have to recover the $500 from Betty and other costs she incurred in helping Betty and (B) explain why such legal theory applies.
