Fact Pattern:

Brian Loneleyheart lived his own house in Georgia with his wife of 40 years, but after her death, he had to move into a nursing home in Gainesville. In choosing his new residence, he was attracted to Pearly Gates Nursing home after reading a brochure that listed several features.The advertised features included a full-time nursing staff with an on-call doctor at all times; a hospital in an attached building that had complete diagnostic equipment and an on-site pharmacy (operated by Happy Pills Pharmaceuticals). In addition, the brochure promoted a friendly community, but with complete protection of residents' privacy, including private rooms with both facilities, and computers in each roomwith the latest in privacy protection software.

After moving in, Mr. Loneleyheart began seeing a Dr. Isaac Barr. Dr. Barr was a Psychiatrist who was self-employed, but had a contract to provide services for patients at Pearly Gates in emergencies. Dr. Barr told Mr. Loneleyheart that he had his own practice, but would see him at Pearly Gates, since he was often there anyway.Dr. Barr diagnosed Mr. Loneleyheart with depression stemming from his wife's death, and suggested that he participate in more community activities while also prescribing him antidepressants.As they parted, the receptionist, Miss Diana Grace, noticed and asked Dr. Barr if Mr. Loneleyheart was alright, since she knew the Doctor usually only came for emergencies. Dr. Barr stated that there was no emergency; he was just seeing him as a patient.

Mr. Loneleyheart next obtains a list of activities and sign-up sheets from Ms. Grace, and signs up for the poker group, the flag football team, and the speed dating club.When each of the committees that choose members goes to review the sign-up sheets, Ms. Grace tells them:"Don't take Brian, I talked to Dr. Barr yesterday and he says that that dude is crazy. I think he has delusions. All of the activities turn Mr. Loneleyheart down, and his depression deepens. He begins to go to a local strip bar for companionship, and meets a young girl who has an affair with him, as long as he pays for her college tuition and promises to get a prescription for Viagra.

Mr. Loneleyheart talks to the Happy Pills pharmacist, who tells him he can get him Viagra without a prescription, but to do it he'll have to swap those pills for his antidepressants. Mr. Loneleyheart agrees, and the pharmacist fills his prescription with Viagra, but continues to label the bottle as the antidepressant. Shortly after this, Mr. Loneleyheart contracts herpes, and makes an appointment with the attached hospital.

The Patchwork Palace, an independent hospital, is attached to the same building as the nursing home, and offers special rates to Pearly Gates residents, which provide 80% of their business. Mr. Loneleyheart makes an appointment with a Nurse Practitioner named Chris Feeley, who diagnoses him with herpes. Mr. Loneleyheart immediately says that he has to leave so he can inform his girlfriend so she can get checked out too. Mr. Feeley tells him to wait and that he would call security if he tried to leave before a doctor could consult follow up the exam. However, Mr. Feeley had said that to keep Mr. Loneleyheart in place long enough to take picture of his genitals with his phone. After doing so, he told Mr. Loneleyheart he could leave, after all. Mr. Feeley then posts the picture on his Facebook site with a warning for all of the women at Pearly Gates to be careful with the guys in the nursing home.Several residents are "friends" on Facebook with Mr. Feeley, and all wonder who is in the picture. Ms. Grace tells several people that "I think that is Wilson James Callahan. I walked in the men's room by accident, and it looks just like him." Mr. Callahan's girlfriend, a Pearly Gates resident, hears this rumor and plots revenge. She steals Mr Loneleyheart's antidepressants and gives them to Mr. Callahan because it has a side effect that causes severe diarrhea. However, since it the bottle actually contains Viagra, Mr. Callahan suffers a heart attack and dies. In the ensuing investigation, it is discovered that Ms. Grace began the rumors, and she is fired by her temp agency, Professional Standards Staffing.
