On July14, 2002 Mr. Smith, a jewelry salesman attended a convention in Houston, Texas. The sales convention was at the Holiday Hilton. Mr. Smith and his wife reserved a room at the Pleasure Inn, a hotel directly across the street from the Holiday Hilton. Because Mr. Smith was an exhibitor at the sales convention, he brought samples worth approximately $450,000 with him. He carried these samples in a standard exhibitor's case. When Mr. and Mrs. Smith arrived at Houston Intercontinental Airport, the Pleasure Inn had a limousine and driver waiting for the Smiths. Sleazy Service provides limousine service to the Pleasure Inn's guests for a flat monthly rate. Mr. Smith claims the airport limousine service was one reason he decided to stay at the Pleasure Inn rather than the Holiday Hilton. The driver told Mr. and Mrs. Smith that he had picked up their luggage, but he had one more passenger to pick up at terminal C. He suggested that the Smiths have a drink on the house and he would be back shortly. When the Smith's reached the Pleasure Inn, they proceeded to check in. At this time, Mrs. Smith realized two bags were missing; one bag contained her $2500 fur coat. Hopeful that the bags would appear, Mr. Smith finished checking in and went across the street to set up his display. Mr. Smith, who is paranoid, generally keeps his most valuable pieces in his hotel room or in the hotel safe. On this occasion, he decided to leave the valuable pieces of jewelry in his hotel room because a "special customer" was coming to see them later that evening. While at the convention, he bought his wife a ring and necklace. Mrs. Smith saw a notice inside the closet door of their room. The notice stated that the hotel had a safe and suggested that guests place their valuables in it. Mrs. Smith intended to wear the necklace that evening and did not place it in the safe. She placed the ring on the hotel registration counter and told the front desk clerk she wanted it put in the safe. The desk clerk acknowledged Mrs. Smith and the ring and stated, "I will take care of that right away'. Mrs. Smith did not see the desk clerk put the ring in a safe nor did she receive a receipt for the ring. Mrs. Smith went outside to join her husband at the hotel's swimming pool. The front desk clerk remembers Mrs. Smith but does not remember placing the ring in the safe. Somebody broke into the Smith's room while the Smiths were swimming and the necklace, the special pieces, Mr. Smith's Rolex watch, and Mrs. Smith's personal jewelry and purse containing $500 were stolen. Jack Reardon, one of Mr. Smith's out of town customers, made plans to meet Mr. Smith in the evening to new some pieces of jewelry. Mr. Reardon had recently bought a vintage '67 Mustang convertible, and even though he did not have insurance, decided to drive it to Houston. Upon arriving at the Holiday Hilton, Bob, a bellboy who was temporarily relieving the valet, exclaimed, "WOW, a '67 'Stang, I'll be glad to park it." Mr. Reardon handed him the keys and said, "Be careful sport, I just bought this baby." Bob gave Mr. Reardon a claim check and took off. Printed on the back of the claim check were the following terms and conditions: "Neither the Safeway Parking Garage no the Holiday Hilton is responsible for any loss incurred becauseof theft." Mr. Reardon did not look at the claim check. Mr. Reardon was already late for his meeting with Mr. Smith, and decided to check in to the Holiday Hilton later. He did not have a reservation at the Holiday Hilton, but knew there were vacancies. At the meeting, Mr. Smith told Mr. Reardon about the robbery. Upon hearing this bad news, he decided to return to Galveston. he went to get his car. The valet told Mr. Reardon that the car was not in the garage. Mr. Reardon informed the valet that he had $60,000 in the trunk. He intended to use this money to buy Mr. Smith's jewelry.
