Scenario

Marta, in a hurry on her way to work, stopped by the Acme Shop Inc. to buy a smart phone charger. At the cash register the cashier appeared busy and was distracted by adjusting things in her lane. Marta said, "I need to get to work. Can you hurry up$?"$ The cashier did not respond and so Marta grabbed for the charger to go to another lane. In the process, she hit the cashier and it is unclear whether she did so intentionally or accidentally. But whatever the case, the cashier reacted violently and started hitting Marta with her fists. Marta was injured. The Acme Shop immediately fired the cashier for violating company policy. Marta filed a lawsuit against Acme Shop Inc. for the tort of assault and battery to recover damages for her injuries.
