Read the scenario and thinking as a Probation Officer you will make the decision of, Should I RecommendtheCourt toRevoke His Probation or Not?

AssignmentQuestion:

  • Do you recommend continuation of Probation.
  • Add special conditions.
  • Add conditions as intermediate sanctions.
  • Recommend reentry program and resources be specific.
  • Complete revocation of probation and return to prison to complete mandatory prison sentence.
  • Which of the above will you recommend and why?

Scenario:

You are the Probation Officer for JohnSmith;Smith is a30-year-oldoffender with ahistoryof serious drug use, threeMisdemeanortheftoffenses and onefelonyconviction for breaking and entering. The current offense is auto theft andpossessionof cocaine. Hereceiveda sentence of 2years' probationwith standard conditions of supervision and arequirementto participate in drug abuse counseling and random drugtesting. Smith did rather well the first 8 months of his supervision, but his behavior then began to deteriorate. In month 9, he missed two of his four appointments with you, with excuses that his car broke down and that there was a family emergency. He also lost his job and has yet to find another. Smith sister called and told you that Smith is back on drugs. You ask him to come in for a random drug test, but the result of the drug test is negative.

In month ten Smith missed two of his drug counseling sessions, claiming that he was not using drugs and the sessions were a waste of time. He stated that he would rather spend his time looking for a job. In month 11 he tested positive for cocaine use. You have not reported any of this to the court, but you have counseled Smith serval times and had told him that continued failure to meet the conditions of this probation could result in recommending the court to revoke his probation and placing him back in prison.

You believe that smith is not a danger to society or his person, as he does not have a history of violence. You also believe that he can conquer his drug use, yet he has not been honest with you and doesn't seem to respond to your intensive counseling or threat to recommend revocation. You must now report his violations to the court and recommend how to deal with Smith.
