The lakefront Air B&B is a third-party residence that serves the same purpose as a regular dwelling or residence. The Fourth Amendment allows some point of privacy, and prevents invalid searches and seizures. However, the Fourth Amendment is a personal constitutional right, and through a third-party residence those rights cannot be vicariously shared. United States v. Kern, 336 F. App'x 296, 298 (4th Cir. 2009). In the case of U.S. v. Kern, the police were made aware that a person with active arrest warrants was currently staying at a family farm. Through talking with Kern's family they learned the house was not a residence to anyone. As with Ziggy, the Lakefront Air B&B was not his permanent residence, but even as an overnight guest Ziggy was present, and this allowed the D.E.A to lawfully enter the property and execute the arrest warrant. Given the similar residence of the two cases, Ziggy's arrest warrant will most likely be held as a lawful seizure performed by the D.E.A.
