After he was no longer dating Ms. Hinchy and had started dating a Walgreen's pharmacist, Audra Withers, Mr. Peterson learned that he had contracted genital herpes at some point in the past. Ms. Withers was concerned about how the herpes was spread and used Walgreen's records to research Ms. Hinchy's prescription history. Mr. Peterson learned of the records and confronted Ms. Hinchy because the records showed she had not refilled her birth control. Ms. Hinchy learned that "(1) a HIPAA/privacy violation had occurred, (2) Withers had viewed Hinchy's prescription information without consent and for personal purposes, and (3) Walgreen could not confirm that Withers had revealed that information to a third party."
