1. Regulatory rules and United's Conditions of Carriage give an airline permission to "deny boarding" to a passenger on an overbooked flight. See Exhibit 1 Sec. 250.2a. See also Exhibit 2 (United Conditions of Carriage) Sec. 2. Exhibit 2 in the definition section defines an "oversold flight" as a flight where there are more Passengers holding valid confirmed tickets that check-in for the flight within the prescribed check-in time than there are available seats. In your opinion, do these sections allow United to remove a passenger that has already boarded the plane to allow seats for transport crew, not paying passengers? Discuss if United may be in violation of these particular sections given that Dao had already boarded the plane and United allocated four seats to transport crew, not paying passengers.
