Renaldo and Clara are going to get married. They go to Chepa Carpets, a business owned by Roger and Joan, to buy carpet for their new house.
They tell Roger, the senior partner in the business, that they want a hard-wearing carpet that will not stain easily. He shows them a carpet they really like, and tells them it this is what they need. He says it is a special new material, 100% stain-resistant, and very hard-wearing.
They buy the carpet, and have it delivered.
When they lay the carpet in their house, they like it so much that they go back to the shop and tell Roger they want the same carpet for their accountancy business in the city.
The carpet is delivered, and they lay it down.
Three months later, the carpet in their new house has been stained by their three dogs and is already showing signs of wear. The carpet in their city office has stains from coffee and clients' dirty shoes, and it is very badly worn.
Renaldo and Clara are angry and upset and want to know what they can do.
(a) Advise them of their rights under common law and any legislation.
(b) Would it make any difference if they had chosen the carpet themselves, and Roger had not recommended it to them?Explain your answer.
