Rescission of contracts can take place in this case:

When the things which are the objects of the contract are legally in the possession of third persons who acted in bad faith

When the party seeking the rescission can perform only as to part and rescind as to remainder

When the seller cannot return the installment paid to him by buyer

When he who demands rescission can return whatever he may be obliged to restore
