NetChoice, examining the constitutionality of laws in Texas and Florida that aim to regulate how large social media platforms control content (Howe, 2024). The laws were enacted in response to concerns about perceived censorship of conservative views on social media. While Texas and Florida argue that the laws address discrimination by social media platforms, tech groups challenging them assert a violation of the First Amendment, viewing the laws as an extraordinary assertion of governmental power over expression (Howe, 2024). Social media content that is publicly accessible is generally considered information in the public domain and law enforcement agencies generally have the authority to monitor public information on social media platforms without a search warrant or subpoena (CRS Reports, 2022). Employers have the right to view social media profiles of job applicants and employees, and they can make employment decisions or refuse employment based on the information they find on social media platforms. Hiring experts stress the importance of aligning social media posts with the values of the healthcare community served and advise maintaining a professional online presence to avoid potential career setbacks (Hochwald, 2024). Realizing the public nature of social media has prompted me to reconsider my posting habits; aspiring to maintain a professional image, I recognize the need to limit my posts, particularly on major political opinions.
