RESPOND to this as D. Haberer in the ROSE LANE CASE
Hello Neighbours!
I hope you're well, and that your beautiful home with a view of Pottenstein Castle has been a successful venture for you.
Unfortunately, as you may or may not be aware, we've had some challenges over the last few years with some of those renting your property. Frequently there are parties going on at all hours of the night, often until three in the morning, followed by loud groups of still inebriated climbers making a lot of noise as they roll out for a 6:00 AM start to their day. The police have had to frequently visit your home to deal with the noise at all hours which is a disturbing event for all of our Rosenweg neighbours. Things have gotten much worse since the introduction of the fire pit and outdoor camping as well, to the point where City Council has now gotten involved and are threatening to make some drastic changes.
According to the City Council, there is a potential ban on all rental units in the region that may come into effect. Rather than banning your ability to rent altogether, there is the potential to reach a mutually beneficial solution, would you be willing to not allow disruptive partying and have a noise limit in place starting at 9:00 PM? Many listings explicitly state no parties allowed, which means significantly less cleanup and better ratings overall on the rental platform!
I'm hoping we can find a solution that is mutually satisfactory for both of us, so you can continue to have a prosperous rental property and I can get out of my driveway safely after a good night's sleep without worrying about the safety of me and my family. If something were to happen to us, our young children, or one of the other neighbours because of a drunken reveller on your property I worry that you'd be personally held liable for damages and legal repercussions as you are in a way directly responsible for enabling it. We all know that visiting climbers have recently been climbing the castle at night while intoxicated, and if they were to hurt themselves in the process it is likely that you would be liable for that as well.
Please consider a ban on partying and a 9:00 PM noise curfew added to your listing and enforced, I would hate to see a full ban put in place by City Council for the entire region.
Thank you for your consideration,
M. Schmidt
