1. Duty of care is the responsibility of a mental health practitioner to give appropriate care to their clients. The duty to warn is the obligation to protect victims when clients may be a risk to them.

The case illustration with Dr. Ranklin and Jonathan goes over the duty to warn. Jonathan has expressed that he wants to harm his supervisor. The therapist tries to talk him out of it, but it does not work. Because of this, the therapist would lead the therapist to release information in order to protect the victim.

Of course duty to warn can conflict with confidentiality. This would lead a mental health professional to be faced with ethical and legal dilemmas. This is something that I am sometimes faced with at work. I work in a substance abuse clinic. Not only do we follow HIPPA, but we follow 42 CFR. This is an additional set of rules of confidentiality that make it even more strict on what you can and cannot release.

So, one example would be if a client got into their vehicle and attempted to drive while under the influence. In this situation we are allowed to contact the police and release information such as their name and what they were driving etc. This is because the client is a danger to themselves or others.

Personally, I believe that your duty of care is that as a provider you should be taking ever measure available to you and the patient to help them recover as well as give them the tools afterward to fully recover and remain as functional member of society. Your duty to warn is where you should be able to give advice to your patient as to the side effect of drugs, what may happen if a disease goes unchecked, and the potential risks of certain procedures, warning people ahead of time can reduce some oncoming stress when that thing occurs. Not following these duties can lead to legal action and a loss of a license. My main question how far ahead of time and the procedure must I warn about, like if an implant is liable to have issues 25 years down the line am I still at fault for that?
