Review the August 2021 decision of the Alberta Human Rights Tribunal in Beaudin v Zale Canada Co. o/a Peoples Jewellers. The outcome of that human rights complaint was: a. The complainant explained that he was "exempt" from the requirement to wear face masks because of health reasons and thus the store staff violated his equality rights by denying him entry. b. The fact that public health officials had not, at the time of the incident, instituted a mandatory mask requirement for retail establishments determines the question. The denial of services when masks were not mandated by a specific law, was a violation of the complaint's rights. c. The complainant, an individual who has a disability which prevents him from wearing a face mask, was able to establish that the respondent discriminated against him in violation of the law by denying him entry into the store. d. The Director found that the respondent's policy was justified in the circumstances, and the respondent had provided for alternatives for those who could not, for disability-related reasons, wear face masks. The complaint was dismissed and that dismissal was later upheld by the Chief of the Commission and Tribunals.
