Ride sharing apps like Uber and Lyft have gained tremendous popularity among drivers and riders. Uber classifies drivers as independent contractors, and therefore does not pay driver car insurance or pay towards Social Security and other benefits.

Carla ordered an Uber to pick her up at work and drive her home via the Uber app. The Uber had a large sign in the window indicating it is was an Uber vehicle. On the way home, she noticed the driver speeding and listening to loud music. As the car came up to a stop light, the driver was looking down at the radio and didn't notice that the car in front of him was stopped at the light. The Uber car rear-ended the car in front and Carla suffered whiplash and a broken ankle from the accident. She would like to sue Uber to cover her medical bills.

The assignment is to represent Uber and SUPPORT it. Use your knowledge about the difference between independent contractors and employees, plus employer negligence to make your arguments.
