Right of pledgee against third persons. Except as provided in Article 2112,. the pledgor remains the owner of the property pledged. The creditor to whom the property pledged has been delivered is obliged to take care of it with the diligence of a good father of a family. l(Art. 2099.) He is authorised to bring such action as pertaining to the owner in order to recover it or defend it, against claims of third persons. Furthermore, unless given the right, the creditor might be prejudiced by the negligence of the owner. The right of a pledgee is a real right enforceable against third persons but it is necessary that the contra ct of pledge be embodied in a public instrument which shall contain a description of the thing pledged and the date of the pledge. (Art. 2096.)
