- Rizwan is an entrepreneur who made a lot of money through his companies, but feeling exhausted and overworked in his 50s, he decided to take time out and sail around the world for a year. Aware that this could be a perilous journey, he made a new will. His two children, Yousef and Nahla, had an incredibly fractious relationship which made Rizwan concerned about litigation over his will. In an attempt to avoid this, he left his entire estate to his sister, Akilah, absolutely. Before he executed the will, he told her over the phone of his plan: "I really want to avoid a fight between them over my will so I'm leaving everything to you absolutely, and you should divide it between them as you see fit." Akilah replied: "But they will just come after me, you know that, right? If that's what you really want though." She then let out a long sigh and ended the call.
Rizwan embarked upon his trip but after two months at sea he was hit by a very bad storm and perished along with the yacht. Nahla told her family that her father had phoned her the day before, knowing he was coming to a storm which he was scared by, and told her to collect the title deeds to his house from the safe in his study, to which he had given her the code, and told her that it should be hers rather than her brother's because she had been his favourite child who reminded him of his deceased wife. Nahla said he also told her to take her mother's jewels which were also in the safe, as he wanted to make sure they she received them if he died. This she did that day.
Advise Akilah as to the validity of these dispositions.
