RM (buyer) entered into a contract of sale with Jin (seller) for the sale of the latter's lot. It was agreed that RM will pay 50% of the purchase price and the balance will be paid in six (6) monthly installments. RM paid the 50% down payment which was received personally by Jin. However, when RM was about to pay the 1st installment, Jin was not in his house - as he was in Seoul, Korea, according to his helper Suga. RM then contacted Jin over the phone who instructed him (RM) to just give all installments to Suga whom he instructed to issue acknowledgment receipts for the payments. When RM learned of Jin's return to the Philippines, he went to him asking for the transfer of the certificate of title of the land to his name. Sadly, Jin refused saying that he did not receive any installment payment as Suga ran way with the money (payments). Can Jin collect from RM again? Why or why not?
