Roger was an ex bank robber, who did a few long stretches in prison, the latest ending in 2015. In this last spell of five years inside, he read the bible and studied to become a lay preacher. Roger died from an inoperable tumour in 2021, which had been discovered a year earlier. He had by then become a lay preacher, and made large sums of money on the preaching circuit internationally and through social media- in 2016 he had spent a year in a theological college in Austin, Texas, one of Adelaide's sister cities.
In 2020, Roger, having had bad news from the hospital about the tumour, telephoned his ex- girlfriend Karen, with whom he remained friends, and said ," I want you to have something for the good memories. So you can have all of my shares in Fortescue right now." While it was still on his mind, Roger posted the share certificate for his total shareholding of 20 000 shares in Fortescue to Karen (and she signed upon delivery of it to her house). In his recent validly executed will, Roger left the following bequests to be held on trust by his two executors, Chas and Dave.
(1) $100 000 to my latest bunch of fellow inmates in the Yatala prison , the 'class of 2010', to be split between them by the trustees (2) $100 000 on trust to fund a project to listen to and record the life stories of terminally ill people. (3) $100 000 on trust to pay return economy airfares from Adelaide to Austin, for Adelaide residents who wish to explore trade or friendship opportunities between residents of the two cities. (4) The residue of my estate to be given to my sister Beatrix absolutely; it would help me rest easier if she gives half of it to support victims of violent crime, but I have faith that she'll do the right thing, as the Lord and myself will be watching.
Advise Chas and Dave on the validity and status of all of the four dispositions in the will, AND also regarding Roger's dealing with the Fortescue shares in 2020.
