Rory sends an email to Andy on Friday afternoon offering to sell him his vintage set of golf clubs, (Andy has previously made a number of requests to purchase these clubs) for 500.Rory states that he needs to know as soon as possible whether Andy is interested in buying them as Rory needs to raise some money quickly to mend his roof.Andy does not see the email until Monday morning and calls Rory immediately to tell him that he would like to accept his offer but can only afford 450 now and 50 at the end of the following week. Unfortunately, Rory cannot hear Andy well and thinks that he says he does not want to buy them.Andy immediately sends Rory an email saying he will buy them for 500. Rory does not check his emails that day and instead sells the clubs to Oluf.
Advise Andy with reference to the contract lawand postal rule. I would like to know if Andy and Roy had a binding contract or not since Roy could not hear what Andy said via telephone but Andy emailed immediately to Roy?
