In my opinion in the state of FL is not duty to protect a third party . The psychiatrist MAY disclosure patient communication to the extend necessary to warn any potential victim and MUST disclose patient communications to the extent necessary to communicate the threat to a law enforcement agency. 456.059 Communication confidential; exceptions. I would like to know what will be the counteranalysis in this case.

CASE:

A student at Loyal University, FL met student Ryan Carnation Fall 2019, they have a brief romantic interaction. Sue immediately fell in love with him since she saw him, she thought he was the love of her life but Ryan did not feel the same, he was scared to see how she began to obsess over him. He finally managed to disentangle himself from Sue.

Sue became distressed at Ryan's disappearing act and decided to seek professional help. Sue had initially confessed her intentions to slay Ryan to her psychiatrist at the University where the psychiatrist had diagnosed Sue with several serious mental disorders and arranged for her to be involuntarily committed, which occurred the next day. However, when Sue was examined, she appeared to be in a stable mental state and was released. The psychiatrist, notified of the release, consulted with her supervisor, Dr. Ima Kweck. Kweck instructed the psychiatrist to take no further action that might result in any additional detention of Sue.

Three days later, Ryan Carnation was murdered by Sue. He had been meticulously dismembered, and his body parts reassembled, with the heart removed and strategically positioned below his sternum. Sue was sitting next to him, carving knives close at hand. Sue was arrested, booked, and charged with murder. After the police uncovered a journal in Sue's dorm room, Ryan's family found out about Sue's conference with her psychiatric, after which Sue happily told everyone all about it. Her lawyer is pursuing an insanity defense. After all, she was just crazy about Ryan.
