Question 2 was: Your client is Joan Lee. You are the first legal practitioner she consulted when she approached your law firm for advice on her legal rights. You believe you conducted an interview that met your professional obligations. After the consultations, you advised Ms Lee that she had a cause of action for N$10 million caused by breach of contract and that all the other requirements were in place to give her sound prospects of success to purse an action in the High Court. Ms Lee instructed you to sue. You sued. The action was defended. The action is now almost ready for trial. The next procedural step is the delivery of witness statements. In terms of a court order issued on 1 March 2024, Ms Lee's witness statement must be filed by 22 March 2024. When you received the court order on 1 March 2024, you immediately informed Ms Lee that the due date for the filing of the witness statement was around the corner and explained to her that you must arrange a consultation with her to start preparing her witness statement. She replied the same day that she could come in for a consultation during the week of 4 to 8 March 2024 and that she would revert with the exact date. Ms Lee did not revert. You called Ms Lee on 11 March 2024 to remind her of the consultation. Ms Lee then told you that she does not have any time to consult with you before 22 March 2024, as she is abroad and has a hard deadline at her work. Her day job is as a member of the engineering team, building the multi-billion-dollar 178-kilometre linear city in Saudi Aribia called "The Line". Ms Lee said you must just prepare the witness statement for her to sign as she does not have time to travel to Namibia to consult with you. What do you do? And why?
