Sacamano University operated a pub on its premises for the benefit of its students. Art Vandelay was a student and a world-renowned guitar player, who attended the pub with some friends for the purpose of celebrating St. Patrick's Day, he became quite drunk. The pub bartenders realized that the student was drunk around 11:00 p.m. and refused to serve him any additional alcohol. They also asked him to leave. Art Vandelay however, remained and drank two additional beers that were purchased for him by his friends.

Some time later, around 12 a.m., one of the bartenders noticed that Art Vandelay was drinking and instructed the pub bouncers to ask him to leave. One of the bouncers did so, but he refused, and the bouncer took him by the arm and escorted him to the door. Along the hallway to the door Art Vandelay was abusive and resisted leaving, but the bouncer managed to eject him from the building. A few minutes later, Art Vandelay returned to the pub and slipped by the doorman for the alleged purpose of obtaining an explanation as to why he had been ejected. About eight feet from the door, he was apprehended by two bouncers and was once again expelled from the pub, although this time Art Vandelay complied, putting up little resistance. Once they reach the front door the bouncers aggressively picked up Art Vandelay and threw him down approximately 12 stairs. Art Vandelay landed awkwardly on his wrist which caused a significant fracture to his right wrist, and a severe concussion. The injury to Art Vandelay's wrist required medical treatment and has since been told by doctors that he may never have normal use of his right hand again.
