Sam, Henry, Paul, and Allen are students at the Namibia University of Science and Technology. One evening while visiting a local shebeen they hear a story about a treasure that is hidden in a certain area of Namibias Skeleton coast. They decide to investigate this, setting aside 5 weekends for the search. They agree to share the treasure between them if they manage to find it. All four the students pay an equal amount towards the rental of a 4x4 vehicle with the necessary equipment. Just before they are due to leave for the first weekend Sam tells them that he would rather spend the time studying; if they do find the treasure, they can just refund him the money that he has already spent. Henry, Paul and Allen spend three weekends searching, with no success. When Henry and Paul get ready to leave for the fourth weekend, they discover that Allen has taken the rented 4X4 vehicle to go camping with his girlfriend. On the fifth (final) weekend Paul also has other commitments, and Henry goes on his own. For security purposes, a friend accompanies him. During this period, Henry discovers the treasure, which apparently has not been claimed by the government. The treasure is estimated to be worth N$5 million.
1.8 Do Sam, Henry and Paul have any recourse against Allen for using the rented 4X4 vehicle to go camping with his girlfriend? Explain in full. (8)
