Samantha is a cat breeder who sells hundreds of cats every month. She of course needs to feed those kittens before selling them, though, and for that she purchases enormous quantities of cat food from Alexander. After failing to pay her bill from Alexander for a while, she racked up a debt of $10,000 to him.

One Monday, Corey walks into Samantha's shop and requests the finest kitten in the entire place. As it turns out, Samantha's best cat comes from a champion pedigree and sells for $4,000. When Corey offers to buy the $4,000 cat, Samantha—remembering her substantial debt to Alexander—asks if Corey would agree to pay the $4,000 to Alexander instead of her, in exchange for the special feline. Corey agrees, and Samantha hands over the cat.

But Corey never pays Alexander the $4,000, nor does Samantha pay any of her part of the debt to Alexander. So Alexander sues Samantha for $10,000—her total unpaid debt to him. Who wins that suit? what can  be done about Samantha Corey's promise? Be sure that both parts of the answer that you select are correct.

A. Alexander wins the suit against Samantha; Samantha cannot recover anything based on Corey's promise, since he made that promise to Alexander, not her.

B. Alexander wins the suit against Samantha; Samantha can then sue Corey for the $4,000 that he had promised to pay Alexander on Samantha's behalf.

C. Samantha wins in Alexander's suit; Samantha does not need to recover based on her promise with Corey, but Alexander should sue Corey instead.

D. Samantha wins in Alexander's suit; Samantha cannot obtain any money from Corey, but she could reclaim her cat if she wanted.
