Sara and her fianc Darin went shopping for an engagement ring at Mandarin Gems.They became interested in a 3.01 carat diamond with a clarity grading of S11.Mandarin gave Darin a written appraisal, rating the ring as an S11 and valuing it at $45,000.Darin bought the ring from Mandarin for $43,000.He then gave the ring to Sara and they were happily married for a few months.Then they got a divorce.The divorce decree stated that Sara could keep the ring.She had the ring appraised and they told her it had a poor clarity grading and was worth only $20,000.Sara sued Mandarin for misrepresentation and breach of contract.Mandarin defended by saying that it did not enter into a contract with her, so therefore her case should be dismissed.Does Sara have a right to sue for breach of contract and if so on what grounds? This was an old assignment question and I have a similar one I just need to see the train of though on how to answer this one to be able to answer the new one.
