Saroj is a sponsored competitive skier who suffered a significant knee injury 4 months ago. One day, she hears of a revolutionary new prescription drug manufactured by FiHi Drug Co. called "MobQi," which was designed to reduce scar tissue and aid in the quick healing of knee tendons which she hopes will expedite her return to competitive skiing ahead of next year's competitive season. Saroj contacted her regular doctor, Dr. Hopely, asking if Dr. Hopely would prescribe her "MobQi." Dr. Hopely tells Saroj she would be happy to schedule an appointment to discuss the pros and cons of "MobQi" and see if it's a good fit, but is currently booked out 5 weeks. Saroj has a qualifying race in 6 months and did not want to wait as she needed to heal fast and get back to training, so she asks Dr. Hopely for a referral for another doctor who may be able to assist her sooner. Dr. Hopely responded by saying, "I would prefer if you see me since I am familiar with your medical history and current list of medications, but if you refuse to wait, I recommend Dr. Decent." Saroj calls Dr. Decent and schedules an appointment for the very next day. When Saroj arrives at Dr. Decent's office, the receptionist tells Saroj that Dr. Decent had an off-site emergency and would not be able to make the appointment but left a prescription for "MobQi" that Saroj had requested for her knee. Saroj filled the prescription and started taking "MobQi." A few weeks later, Saroj suffered a stroke that caused partial paralysis on the right side of her body. It turns out that "MobQi" had a rare interaction with some performance enhancing vitamins Saroj had been taking for years, increasing her blood pressure levels to an extreme level, likely causing the stroke. Saroj was told that with physical therapy she may regain partial use of the right side of her body but that it was very unlikely she would ever have full movement or be able to ski ever again. Saroj is devastated. Discuss all potential claims Saroj may bring against FiHi Drug Co., Dr. Hopely, and Dr. Decent
