Scenario 1: Chad Charles is a truck driver who works for a produce company called Fresh Fruits. In the early evening of December 14, 2019, he was driving his truck on a highway from Clayton to Dandenong. In the direction Charles was travelling there are two lanes, and the highway is surrounded by farm land. The lane markings indicate that the changing of lanes is permitted on the highway. Charles was travelling in the lane farthest from the centre of the highway and closest to the farm land. The posted speed limit was 100 km an hour, and Charles was driving 80 km an hour. Fred Free was also travelling to Dandenong, and was driving his sports car in the lane beside Charles. Free drove up beside Charles, and they both started gradually increasing their speed to the point where they were going 100 km an hour beside each other. Free then increased his speed to 110 km hour and Charles also started to speed up. Free got a bit ahead of Charles, quickly signaled he was changing into Charles' lane, and did so. When Free changed lanes, Charles thought his truck was about to hit Free's car which was now a short distance in front of him. Charles swerved out of his lane and towards a corn eld which was on the side of the highway. Charles started applying his brakes, but was not able to stop until he went about 15 meters into the eld. Just before Charles stopped he rammed into a structure. Charles got out of his truck and saw that he had run into a wooden playhouse. A child exited the playhouse with a broken arm- The child was Sarah Summers whose family lived on the farm. Her father Sam Summers came running and was devastated when he saw that his daughter was hurt and the playhouse he had built was mined. Sarah Summers broken arm recovered in a few months, and Sam Summers had to pay $20,000 for the medical bills. Charles suffered a broken arm and his car was seriously damaged. He had to spend $20,000 for the medical bills and $15,000 for repairing the car
