Scenario 1:

Facts:During the manufacturing process of BIC lighters, it is possible for microscopic brass tailings to be left in the lighter. These tailings can be ignited causing afterburning and explosions. A woman was injured in a boat fire when her husband used a lighter within seconds of fueling a boat.

Question: Do you think this is a danger that everyone should just face and BIC have no liability, or should BIC be required to compensate her?

Scenario 2:

Facts:A person is trying to determine what is in a pipe that they are working on at a construction site. They take out their BIC lighter and attempt to use it to look inside not knowing that it contained flammable gas. The gas in the pipe ignites when it comes into contact with the lit lighter and severely burns the person.

Question: Does this sound like a case where BIC should be held liable? Why or why not
