  • Determine whether Mitchell's statement and resulting actions by the school violate the First Amendment.Provide support your answer.

Yes, Paul Mitchel violates the first amendment act

First things first is to understand the First amendment act which is a law that gives the freedom and rights of speech to any citizens in the US. Although this law is guaranteed there are some words or utterance that can cause about breach of peace for other people or rather parties or rather bring about discomfort to them as the speech may be disturbing or they may find them unsafe and inappropriate for their safety. Now to the unprotected speech by the first amendment law which is the speech that causes threats and commitment of violent acts towards other parties. And the court is right to find the defendant guilty of these threats even if they did not specifically or rather exactly intend to do any of the words they stated. Therefore from the case we have above its clear now that Paul Mitchell is violating the first amendment act for the fact that he first of all says that his history teacher should be shot and this is a threat and one of the speeches unprotected by the first amendment act. This is hence against the constitution or rather against the first amendment act that Paul Mitchel goes around posting threats and speeches causing discomfort in their freedom and security. So yes Paul Mitchell violates the First amendment rule.
