Scenario: Back in the past, a user tried to buy a DLC content for an app on Google Playstore. But, the first transaction was somehow

Scenario:

Back in the past, a user tried to buy a DLC content for an app on Google Playstore.

But, the first transaction was somehow rejected by his bank. Since It's not a big deal, he tried to purchase the DLC content again, but this time, it will be treated as a new, second transaction and it was completed afterwards.

Note: The second transaction which was completed, has the same order ID as the first one.

The first transaction which was failed should be closed-down and canceled. But little did he know that in Google's servers, the first transaction was supposedly put on hold. Just waiting for the Google system to be somehow refreshed so that the order will be requested and completed again.

Note: On his Google Pay history, the first transaction is already marked as declined. It stayed the same even after the whole of this scenario..

Almost 2 years after the transactions, Google's payment system requested the payment of the first transaction again. Without his consent, this payment will later be completed immediately as his bank card is added into his Google account, not even a OTP or TAC is required.

He, after realized all of this, called his bank HQ in the first place. But, his bank isn't picking up any calls from him. So afterwards, he decided to email Google Support regarding the issue and wanting for a refund.

Google is happy to refund this order but unfortunately, Google states that this is out of their refund policy:

  • For purchases made over 48 hours, you must contact the developer of the app to troubleshoot and find if you can get a refund.

Then, he emailed the developer of the app, stating that he would like a refund on this accidental order.

Unfortunately, the developer refused his request. Stating that he had already claimed and used the DLC content, so they wouldn't be able to grant him a refund.

Confused, but he sent a follow-up email explaining that nothing is wrong with the second transaction, he just want a refund of the first transaction which was revived magically.

Impressively, the developer has a blazing fast response speed. However, the developer still replied that they are unable to refund claimed orders.

No matter how hard he tried to explain the issue to him, the developer just replied to his email with the literally same Copy N Paste styled reply.

He, being sick and exhausted from this potentially brain-dead developer, decided to contact his bank to dispute and chargeback this transaction.

Note: In this scenario, he didn't even get the DLC content of the revived first transaction. He is basically like donating money to the developer, and getting without anything in return.

From the perspective of law:

  1. If a chargeback dispute occurs, do you think that he will be able to win this dispute easily to get his refund? Explain your answer and why.
  2. Do you think that Google has the right to request and complete the first transaction that should be supposedly rejected, even without notifying the user about it in the first place?
  3. Do you think that the user will have any percentage on losing the dispute. Thus having him to pay the chargeback dispute fee and lost the money at the same time?
