Scenario
Steels R Ours (SRO) is a manufacturer and supplier of steels in Suva. General Contractors Ltd (GCL) agreed to purchase 50 tonnes of steel from Steels R Ours. The price was fixed at $5,000 per tonne. The delivery was to be made 2 weeks after the signing of the agreement. The agreement was signed on 01 March 2021. The price was to be paid one month after the delivery of the steel to General Contractors Ltd's yard in Manoca, Nausori. To ensure that the steel complies with the National Building Code 2020 (NBC); non-destructive tests such as bending, di-penetration, magnetic particles are carried out to find the strength of the steel structure. General Contractors Ltd sold 40 tonnes of steel to Easybuild but had to recall the steels because it did not meet the requirements of the NBC 2020. (a) Advise General Contractors Ltd (GCL); and
(b) How would your answer differ from (a) if Steels R Ours was unable to conduct the strength test due to unforeseen circumstances and as such only supplied 15 tonnes of steel?
