SCENARIO You are a registered migration agent. A little while ago, you attended a face-to-face networking event for business professionals organised by an online migration networking group. You joined this group on Facebook, and this was the first networking event you attended. You had a great time and made many new connections. You have found that this event and the connections you made have resulted in an increase in the number of referrals you have received for your business. You are over the moon about this! You are finishing up for the day when you receive a phone call from one of the contacts you made at the networking event. He tells you that his friend, Julian, a French national, requires your assistance. He recently arrived in Australia on a Working Holiday Class TZ (subclass 417) visa and wants to find a pathway to remain here permanently. Julian left Paris, the city of love, suffering from a broken heart. He saw on Facebook that his former girlfriend just got engaged and so he never wants to return to Paris again. Julian completed the equivalent of Certificate III in Bakery at a famous TAFE in Paris. He worked in one of the most famous bakeries in Paris for four years. He had a bright future ahead of him and was well known on TikTok for his bakery delights. Julian, having tasted the standard of bread and pastries provided in bakeries and supermarkets in Australia, was horrified at the quality. Julian applied for many jobs but was not successful, as employers did not want to take a chance on someone who only held a temporary visa. Julian heard about the buzzing hipster scene in Castlemaine, Victoria 3450 and travelled there to see what it was all about. Julian fell in love with the town as soon as he arrived. He liked the natural surroundings and the buildings, and the people were so welcoming. He felt like he really belonged there. He walked into the first bakery he saw to try out the treats and not only did he fall in love with the atmosphere in the bakery, but he also fell in love with the bakery owner. He felt like it was love at first sight but was disappointed to see she was wearing a wedding ring. They had a great conversation and she offered him a job if he could sort out a more long-term visa plan to remain in Australia permanently. She was happy to support him in any way to achieve this, but did recommend that he look at all options, as the business had to use their funds carefully due to the financial crisis. She, however, was really eager for him to stay. He began working for her straight away and has hit the ground running! He loves the job, and the community loves him! He found accommodation and is becoming quite popular among the locals and recently celebrated his 30th birthday there. It was a special night. The party continued on the main street, and everyone ended up doing the "Can Can" when the clock hit midnight. Julian has decided that he has found his new true home in Castlemaine and is keen to continue his passion for baking and start a new life here. QUESTION 1. What visa options are available to Julian to remain permanently in Australia? You must explain all the requirements for the visa options, including requirements for an employer, if any. 2. What visa options would you recommend and why? You must support your answers with reference to the specific legislative or regulatory provisions
