Scooby Don't, a 4 year-old male Labrador mix dog, was the unofficial greeter of Dr. Alan Harper, a local veterinarian at The Pet Clinic, Bridgewater, MA. Scooby, a rescue dog was playing with a small child under the desk in the vet's reception area when Scooby bit off a portion of the child's ear and the boy was required to undergo several reconstructive surgeries in addition to sutures (stiches). Plymouth County officials considered the injuries "severe", and as such had sufficient cause for what is known as dangerous dog destruction. The agency cited a state law to support its move. According to Mass. General laws, after quarantine, the dog is then to be destroyed. Under the law, because the injury was considered severe, the dog is to be euthanized (destroyed) without regard to the circumstances of the event. Dr. Harper, Scooby's owner, is your client and he wants to know if you can pursue a legal cause of action to prevent the town of Bridgewater and its Animal Control Officer from euthanizing ( putting down") Scooby. Does the town of Bridgewater's impending action violate federal law? Which law or laws? If so, what arguments would you make to the court in your effort to save Scooby? Explain in detail, Counsellor.
