Scott and Dan formed a partnership for the purpose of operating a trash collection business.Both men participated in the operation of the business such as collecting trash and other operations and when either of them were unable to work, the nonworking partner would hire a replacement person at his own expense.Scott approached Dan and requested that they hire a third person to work when either of could not work.Dan refused.Notwithstanding Dans refusal, Scott, on his own initiative and expense, hired a worker when he could not work.Scott therefore paid the worker out of his own pocket.Once again Dan objected to Scotts decision.Specifically, Dan stated that additional labor was not necessary and refused to allow partnership funds to be used to pay for the additional worker.After paying more than $18,000 to the worker without any reimbursement from either partnership funds or Dan, Scott sues for reimbursement of his expenses.Decide who should win the case.
