Scott, who is getting married on Aug 6th, is looking for a good caterer for the reception. He hires Scottsbluff Fine Foods to cater the event. The written contract calls for enough food and drinks for 100 people to be delivered by no later than 1 pm on Aug 6th to the venue. This allowed several hours of prep time for them before the 4 pm start of the reception. On the morning of Aug 6th, SFF's kitchen explodes in a horrible gas leak accident. No one from SFF is hurt in the blast. SFF does not attempt to contact Scott about what happened. At 1:30 pm, on Aug 6th, in a panic, Scott runs to KFC and orders enough food for the reception. At 3pm, SFF shows up to the reception and attempts to deliver the food. Scott refuses the delivery. SFF sues Scott for breach of contract. If you were the judge, how would rule you on this case and explain the legal reasoning why?
