QUESTION 1 (40 Marks) Mr Peters approaches you for advice on 20 October 2017. He was dismissed without a hearing on the 12th of August 2017, after his employer, Mr Kyle Davis, lost his temper and told him to get out of his premises because Mr Peters was an hour late for work. Mr Peters wants to proceed further with the matter. Give him full advice on the following issues.

1.1 The substantive and procedural requirements that must be satisfied during disciplinary action by the employer. You are required to refer to the Labour Relations Act 66 of 1995. (25 marks)

1.2 Any benefits that Mr Peters will be entitled to whilst he is unemployed. You are required to demonstrate the calculation of such benefits by reference to relevant legislation. (15 marks)
