Section A Essay Question 2 Bob late last night was skimming the website of Sells-A-Lot an international computer and video game merchant. Bob has never played video games personally but each year he would purchase the latest and greatest video game system for his daughter as a holiday gi for her. The SellsALot website listed on a large banner ad \"2021 is the year of the new Xbox gaming system and with a retail price between only $299.00 to $499.00, get them while you can.\" Bob tried to purchase the Xbox gaming system through the website by use of its \"Buy it Now" button only to receive the following pop up from the Sells-A-Lot website \"Sorry due to the unprecedented desire of this product and the shortage of microchips due to COVID-lg' all sales are limited to in store purchases only.\" Bob could not sleep last night, fearful of disappointing his daughter. At day break he drove to Sells-A-Lot's storefront location and waited for them to open. Upon Sells-A-Lot's opening, he ran through the store in a mad dash to secure the desired new Xbox gaming system. Bob grabbed a box marked prominently \"Xbox Gaming System Series 31 DISPLAY BOX ONLY" but was surprised by how light it was. Bob waited in line for the next available Sells-A-Lot cashier and happily handed over the box and his cash to the cashier, saying to him \"Please hurry, as I am very tired and I want to purchase this Xbox gaming system.\" The Sells-A-Lot cashier responded, \"sorry, that is only a display box and not an actual gaming system thus it is not for sale, we are totally sold out of the Xbox Series X and do not expect any more until next year.\" Bob now sobbing and begging asks the Sells-A-Lot cashier \"Please, please help me, I am completely broken down and have no alternative choices.\" The Sells-A-Lot cashier then offered a \"Xbox Series S\" gaming system to Bob which he happily accepted paying the requested $299.00. When he arrived home, Bob was surprised to find out his daughter did not want the Xbox Series S game system as it was not the latest and greatest, but in fact she wanted only a Xbox Series X game system. Unknown to Bob, an invoice was included within the Xbox Series S box that he purchased which included the following statement \"Any and all claims against Sells-A-Lnt must proceed through binding arbitration and that if a buyer did not agree to arbitration the buyer must return all contents of the box within twenty (20) days of receipt.\" 1. \"that are the respective rights between Bob and SellsALot and what defenses may be raised? Discuss. 2. Is Bob bound by the arbitration provision? Discuss
