Their needs include that the business enterprise must have its own legal personality, and it must survive the death of either Helena or Imma. With reference to the facts of the above scenario, answer the following questions: 4.1 Indicate and motivate which 'type' of business enterprise would suit Helena and Imma's needs. (2) 4.2 Based on your answer in question 4.1, briefly discuss an `advantage' and 'disadvantage' of 'this' type of business enterprise. Jackson, a struggling student with little to no income, was recently approached by Kaleb, an employee of the 'credit provider' known as "Jackal & Hyde Loans'. Kaleb, who was walking from door-to-door in Jackson's street, approached Jackson while Jackson was studying on his flat's street-facing patio. During their conversation, Jackson indicated that he is struggling to fund his studies and maintain himself while studying. Kaleb offered Jackson a loan- there and then- to the value of R80 000.00, which Jackson immediately accepted. This loan was reduced to writing on Kaleb's laptop, printed by Jackson, and was immediately signed by both parties. This agreement states that Jackson must hand over his identity document, bank card and pin number at the beginning of each month so that Kaleb, on behalf of "Jackal & Hyde Loans', can withdraw the due loan instalment on a monthly basis until the loan debt has been satisfied. With reference to the facts of the above scenario, answer the following questions: 5.1 Explain to Jackson whether the National Credit Act, 34 of 2005, will apply' to the agreement between him and Jackal & Hyde Loans'.
