Several months after hiring W as an information technology (IT) business analyst, the employer's computer system was the victim of an after-hours unauthorized remote access. In addition, a back-up data tape was missing. W suggested the executive management should be contacted and the police informed. Without waiting for permission, W contacted the employer's board chair and the police. The latter said that the complaint must come from the employer. The employer told W that they thought he was the data thief. The next day, the employer told W that he was no longer suspected but that they were terminating his position as part of "downsizing". The worker filed a complaint with the Workers' Compensation Board that he had been discriminated against pursuant to Part 3, Division 6, section 151 of the Workers Compensation Act, which refers to "occupational environment." He argued that the phrase "occupational environment" is broad enough to include discrimination based on concerns by a worker about data security. The Occupational Health and Safety Regulation passed under the Act deals with workplaces where employees come in contact with toxic substances, dangerous machinery, heavy construction, and the like.
